Terms of Service

By accessing or using the 2° platform ("Platform," "Service," "we," "us," or "our") at host2degrees.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Platform. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

2° is a private home-sharing platform that enables users to list, discover, and book short-term accommodations within trusted social networks. We are a technology platform only. We do not own, operate, manage, or control any listings, and we are not a party to any agreement between hosts and guests.

You must be at least 18 years of age and capable of entering into a legally binding contract to use this Platform. By using the Platform you represent and warrant that you meet these requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information and to update it as necessary. You may not transfer your account to any other person.

Hosts are solely responsible for:

• The accuracy and legality of all listing content.
• Ensuring their property complies with all applicable local laws, regulations, zoning requirements, homeowner association rules, lease agreements, and short-term rental licensing requirements.
• Obtaining any required permits, licenses, or insurance.
• The condition, safety, and cleanliness of their property.
• Accurately representing the property to guests.
• Collecting and remitting all applicable taxes (occupancy tax, sales tax, etc.).

2° makes no representations that hosting is permissible in any jurisdiction. It is your responsibility to verify compliance with all applicable laws before listing your property.

Guests are solely responsible for:

• Reading and complying with all host rules and listing terms.
• Treating the host's property with care and respect.
• Any damage caused to the property during their stay.
• Complying with all applicable laws during their stay.

2° charges a platform service fee on each completed booking. The applicable fee percentage is disclosed to hosts on their payout settings page. Fees are deducted automatically from the booking amount before funds are transferred to the host. Fees are non-refundable except where required by law.

Payments are processed by Stripe, Inc. ("Stripe"), a third-party payment processor. By using the payment features of the Platform you agree to Stripe's terms of service and privacy policy. 2° does not store payment card details. We are not liable for any errors, failures, or losses arising from payment processing by Stripe.

For paid bookings, payment is authorized (not captured) at the time of booking request. Payment is captured when the host confirms the booking. If a booking is declined or cancelled before confirmation, the authorization is released and no charge is made.

Cancellation policies are set by individual hosts. 2° does not guarantee refunds. In the event of a dispute between a host and guest regarding a refund, 2° may, in its sole discretion, attempt to mediate but is under no obligation to do so and its determination is final. 2° is not liable to either party for the outcome of any such dispute.

You agree not to:

• Use the Platform for any unlawful purpose.
• Post false, misleading, or fraudulent content.
• Circumvent or attempt to circumvent any Platform features, security measures, or payment systems.
• Harass, threaten, or harm other users.
• Use the Platform to send unsolicited communications.
• Violate any third party's intellectual property or privacy rights.
• Sublicense, resell, or commercially exploit Platform access.

Violation of these prohibitions may result in immediate termination of your account without notice or refund.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 2° DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO WARRANTY REGARDING THE QUALITY, SAFETY, OR LEGALITY OF ANY LISTING, HOST, OR GUEST.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 2° AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO PROPERTY DAMAGE, PERSONAL INJURY, LOSS OF DATA, LOSS OF REVENUE, OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO 2° IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100).

You agree to indemnify, defend, and hold harmless 2°, its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Platform; (b) your listings or bookings; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) any dispute between you and another user.

Any dispute arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the jurisdiction where 2° is registered. Each party shall bear its own costs. This clause does not prevent either party from seeking injunctive relief in a court of competent jurisdiction.

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which 2° is registered, without regard to conflict of law principles.

We reserve the right to suspend or terminate your account and access to the Platform at any time, for any reason or no reason, with or without notice, including for violation of these Terms. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will survive.

The Platform integrates with third-party services including Stripe (payments), Twilio (SMS verification), Resend (email delivery), and Google (authentication). Your use of these services is subject to their respective terms of service and privacy policies. 2° is not responsible for the practices or policies of any third party.

The Platform and its original content, features, and functionality are owned by 2° and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission. You grant 2° a non-exclusive, royalty-free, worldwide license to use, display, and distribute content you post on the Platform solely for the purpose of operating the service.
